Chapter 7

The most common remedy to discharge unwanted debt. You will need to provide financial information including all the people that you owe money to, copies of tax returns and payroll information or other income information. After a Bankruptcy petition is filed you are protected from your creditors and the debts will be discharged.

Chapter 13

Unlike Chapter 7 bankruptcy, Chapter 13 allows you to potentially retain most or all of your assets. Typically, you can pay off your debts to a court-appointed Chapter 13 trustee, interest free, over a period of five years. This is an ideal option for individuals who have a lot of equity in real estate equity but are behind in mortgage payments.

“It took a long time for me to get all the information for my bankruptcy case, but I appreciate Mr. Warner’s patience and many text messages and phone calls to me reminding me of what I needed to prepare the case, and the case went through without any problems. I was very pleased.”

Patricia H.Glen Cove, NY
